The US Federal Trade Commission’s recent sanction against an AI firm for deceptive marketing of AI content detection tools signals increased scrutiny over AI claims and practices [74].

Intellectual property challenges surface prominently, with courts globally, including India’s Supreme Court, clarifying nuanced copyright and design law boundaries in AI-generated content disputes via the ‘twin test’ methodology [12,29]. In response, legal firms incorporate AI toolkits and fortify contract redlining methodologies targeting AI-specific IP, data rights, and liability issues, highlighting legal sector adaptation to AI complexities [46,53].

Concurrently, the misuse of DMCA takedown claims by public figures to censor lawful content underscores growing abuse potential in copyright enforcement systems [30].

Misinformation and defamation risks escalate as social media giants face lawsuits over AI chatbot-generated false claims, highlighting emergent challenges in liability and content moderation frameworks [87]. Furthermore, AI-produced fake books in niche markets such as sapphic literature represent tangible economic harms to legitimate creators through plagiarism and copyright infringement, underscoring AI’s disruptive cultural impact [33]. Similarly, AI deepfake videos of public and deceased figures have sparked ethical debates about consent and digital dignity [82].

Sector-specific ethical guidelines advocating transparency and human oversight, especially in journalism and defence, are gaining critical traction to mitigate bias, misinformation, and reputational harm [38,78,89].

Reports reveal intensified campaigns against AI models trained on pirated or unlicensed materials, evidencing a growing friction between content creators and AI developers over dataset provenance [75]. High-profile disputes, including Japanese legislative debates on AI art copyrights and lawsuits such as The New York Times’ action against OpenAI over unauthorized data use, mark a pivotal era in intellectual property law [94,99].

Innovations in AI infrastructure and rights management technologies are gaining investment and traction. Camp Network’s $30 million financing for an intellectual property blockchain aims to streamline AI rights, provenance verification, and royalty distribution, addressing a major industry pain point [73]. Kasm’s launch of a secure AI Workspace Registry offers containerised environments that reconcile enterprise AI innovation with compliance and risk controls [74].

Strategic partnerships, such as Box’s collaboration with IBM, seek to expand AI adoption in business ecosystems while embedding governance tools to ensure ethical AI utilisation [69]. Australian public opinion strongly favours AI regulations despite limited political focus in electoral debates [50].

The evolving AI landscape demands organisations and policymakers adopt a multi-dimensional approach integrating legal foresight, ethical vigilance, and technological innovation.
